URGENT ACTION NEEDED: The Radical Left Is Voting to Make Roe Permanent

The radical Left is using the leaked Supreme Court draft opinion to force a vote tomorrow in the United States Senate on a bill that would codify Roe v. Wade. In our initial legal analysis, we concluded that this legislative attempt to make Roe permanent – even if the Supreme Court strikes down Roe – is unconstitutional. In the next 24 hours, the fight for life is critical.

In a recent press conference, Senate Majority Leader Chuck Schumer indicated how serious the Left is on codifying abortion as a federal right: 

First, it is our intention for the Senate to hold a vote on legislation to codify the right to an abortion in law. Second, a vote on this legislation is not an abstract exercise; this is as urgent and real as it gets. We will vote to protect a woman’s right to choose and every American is going to see which side every Senator stands on.

The Left is insistent on getting this bill passed despite what the Supreme Court rules in Dobbs v. Jackson Women’s Health Organization. Speaker of the House Nancy Pelosi pointed out one of the strategies to get this bill passed without knowing the final decision of the Supreme Court:

I do think it puts an urgency on what is happening on the election. Two – one or two more Senators could sweep back the filibuster rule for this purpose. And then women would have the right to choose.

ACLJ Director of Government Affairs Thann Bennett gave his insight into how close this vote will be:

Let’s work backwards for a minute. If he gets to a final vote on substance, we know . . . there are 51 U.S. Senators including two Republicans that would agree with that as long as the language is what they prefer, which Leader Schumer can accomplish. Once he gets on the bill, he can make it that language, so he can enact the bill. So really, the vote we need to be looking at is this cloture vote, to end the filibuster. Let me put this as simply as I can, he needs one vote there. As we sit here today, there are 49 U.S. Senators in favor of . . . getting around the filibuster in order to enact this legislation. Only Joe Manchin . . . is not willing to go there. We are within a single vote, and we should not assume that Leader Schumer is not trying to get that vote.

It is that close. We are in a battle to protect the integrity of the Supreme Court and the unborn like never before. ACLJ Senior Counsel for Global Affairs Mike Pompeo explained how critical this battle is:

I don’t think there is any doubt about the fact that this is serious. I hope that everyone who cares about protecting the unborn, the basic right of that child to be born. So fundamental. We have seen Roe since 1973, now 50 years of policy, and we’re seeing how badly that was decided and the damage it has done to not only the lives of the unborn, but to the women who have aborted those children. I hope everyone can see that this is a real moment.

The leak was intentional. It was designed to create exactly the public pressure that you are seeing, with the protests at the homes of Supreme Court Justices against the law. I think you can see this is precisely the energy they were trying to stir. Those of us who believe in this basic idea that life begins at conception and that the United States has a responsibility to protect each of those lives need to make sure that we communicate with our elected officials at every level, at the state level where this could ultimately be decided, and in the hours in front of us at the federal level to make sure they don’t break the filibuster in a way that would allow the codification of Roe v. Wade. It would be bad for the unborn. It would be bad for the American soul, and it would be bad for American politics as well. This issue should be fought out democratically. . . . If Chuck Schumer has his way, that won’t be so.

We are only 24 hours away from this vote and we have to be ready to fight this bill every step of the way. This is the biggest legal and legislative battle of our generation and the ACLJ is equipped to defend the unborn from Capitol Hill all the way to the Supreme Court if necessary.
